Guidance Regarding Department Activities to Protect Certain Facilities from Unmanned Aircraft (Drones)

On April 13 2020, the United States Attorney General's Office released the following Memorandum regarding drones and counter-drone (cUAS) technology.

INTRODUCTION: "Law enforcement and security agencies play a crucial role in ensuring the safe and secure integration of drone technology into the airspace. As recognized in the Department's 2019 Policy on the Use of Unmanned Aircraft Systems, drone technology has transformative potential as a valuable law-enforcement and public-safety tool, including for use in crime scene investigations, search and rescue operations, and security assistance. As drones become more powerful and capable, however, they also become a more attractive tool for criminals, terrorists, and other bad actors to cause disruption and destruction. Unfortunately, the threat is not theoretical."

The public document goes on to say, "To assist the Department of Justice ("DOJ") and Department of Homeland Security ("DHS") in combatting these threats, Congress passed the Preventing Emerging Threats Act of 2018 (codified at 6 U.S.C. § 124n) ("the Act"). The Act provides DOJ and DHS with a tailored grant of authority for authorized Department components to take certain counter-drone actions, notwithstanding certain provisions of federal law that could potentially constrain necessary and appropriate actions to mitigate credible drone threats to designated facilities and assets."

"Today, I have issued guidance under the Act entitled, Guidance Regarding Department Activities to Protect Certain Facilities or Assets from Unmanned Aircraft and Unmanned Aircraft Systems (“the Guidance”).  As authorized components, your counter-drone activities conducted under the Act will be governed by the Guidance. The Guidance outlines the process by which your components may seek approval for the use of counter-drone technologies and request designation of facilities or assets for protection.  As a general rule, not every facility or asset will qualify for protection.  Only those considered “high risk and a potential target” for drone activity–and relate to one of the authorized DOJ missions enumerated in the Act and the Guidance –will qualify."

About Leach Strategic Partners

Leach Strategic Partners  is an unmanned aerial system (UAS) consulting service company for public safety and security companies. Founded by Ron Leach, a 23 year veteran of the New Jersey State Police (NJSP) and a veteran of the United States Navy, honorably discharged.

Ron is the principal consultant for the business. He holds several Federal Aviation Administration (FAA) Pilot Ratings including Private Pilot, Airline Transport Pilot, and Remote Pilot for UAS. Ron was the Chairman of the NJSP UAS Working Group. The group was tasked with developing a direction for the use of UAS and counter UAS technology.

Ron served as a member of the U.S. Department of Justice, Law Enforcement UAS Working Group, and Co-Chaired the New Jersey Office of Homeland Security and Preparedness, Domestic Security Preparedness Task Force - UAS Subcommittee. He has been published in NJ Cops magazine, presented to the New Jersey State Association of Chiefs of Police, and contributed to the ANSI UASSC Standardization Roadmap for Unmanned Aircraft Systems.

Ron has in depth understanding of issues related to counter-UAS (c-UAS) technologies and the current limitations that prohibit its use. Ron has worked with MetLife Stadium security staff to assist in addressing some of these issues and has made c-UAS recommendations to the NJSP members assigned there.

Ron has provided guidance to several state and local law enforcement and fire departments as well as security teams regarding UAS operations. Prior to retiring, Ron obtained a "Top Secret" security level clearance sponsored by the NJSP.

Influential Drones provides part 61, manned aircraft (single/multi-engine, seaplane, tailwheel, instrument) and part 107, unmanned aircraft instruction. They work with academia in support and development of aviation programs. The company provides specialty aerial services for commercial media, corporate and agricultural customers.

Influential Drones has FAA authorizations to fly UAS §107.29 at Night and §107.39 Over Human Beings. It is the only drone company in the State of New Jersey licensed by the NJ Environmental Protection Agency to disperse chemicals by drone.

The Rare Species Fund (RSF) hand-delivered three EVO Rugged drone kits to rangers from the Uganda Wildlife Authority (UWA) in Kampala last week. The UWA is the governmental agency responsible for maintaining and patrolling the national parks of Uganda, which is home to many endangered and threatened species, including elephants, rhinos, chimpanzees, and the very rare mountain gorillas. Poaching remains the largest threat to the conservation of much of Uganda’s wildlife. The RSF provided UWA with its first ever drone in 2017.

This drone has been successfully used to monitor five of Uganda’s national parks, including Bwindi Impenetrable Forest, a mountainous and thickly vegetated region in southwestern Uganda. Using advanced drone technology allows rangers to quickly and remotely look for signs of human activity in order to know where to best focus patrols. The ability to fly a drone to the top of adjacent mountains means that in minutes, rangers can accomplish surveillance in areas that previously took hours to reach. This has increased the overall effectiveness of anti-poaching efforts and is making the national parks safer for native wildlife.

Due to the effectiveness of drone assisted patrols, UWA requested three additional drones to allow more monthly flight time in each of its parks. Influential Drones and Autel Robotics were able to provide three EVO Rugged drone kits for anti-poaching use. The EVO drone is well suited for use by rangers in this capacity. Due to its portable size, rangers can carry drones on patrols, allowing them to monitor areas of the parks that were previously difficult to access. The Rugged Bundle is nearly bullet proof and is a “must have” in the harsh environments of central African jungles. Due to the successful usage of the first drone provided to UWA, we are excited about conservation potential of the three new Autel EVO drones and look forward to their use in field.
